IV. First Amendment Protections

This chapter examines the First Amendment protections available to law clinics and their faculty when the government interferes with their clinic operations. The chapter begins with an excerpt from an article by Joy (“Government Interference with Law School Clinics and Access to Justice: When Is There a Legal Remedy?”), followed by an excerpt from an article by Professor Jonathan Entin (“Law School Clinics and the First Amendment”). The chapter then presents materials from Bedi vs. U.S. House of Representatives Committee on Education and Workforce, a case in which two Northwestern University School of Law clinical professors successfully resisted efforts of a House Committee to obtain clinic records and chill their representation of clients.
