III. Professional Responsibility Duties
This chapter addresses the professional responsibility duties of law clinic faculty faced with attempts to interfere with the representation of clients, the professional responsibilities of lawyers seeking to interfere with clinic representation, and the professional responsibilities of law deans and faculty when faced with interference. The chapter begins with an excerpt from an article by Kuehn and Joy (“An Ethics Critique of Interference in Law School Clinics”) that examines the ethical limits on those seeking to interfere with clinic client selection or representation, and the ethical responsibilities of law clinic faculty, deans, and other faculty facing interference in their clinical programs. The chapter then contains a short description of, and links to, the court order and amici briefs filed in support of the Susman Godfrey law firm’s efforts to have the 2025 President’s Executive Order interfering with their client representation declared illegal.
